Eligible Partner | a member of the MYOB Partner Program based in Australia (including Partner, Certified Consultant, Bookkeeper, POS or Connected Account Programs and customers who have commenced their application to become an MYOB Partner Program member). |
Eligible File | An Eligible Product file that is being provisioned for a new customer. For the purposes of these Terms, a “new customer” is a customer of an Eligible Partner who at the time this offer was published, was not a current MYOB subscriber (either on a trial or paid basis). |
Eligible Products | a base subscription to “MYOB Business Connected Ledger”, “MYOB Business Connected Ledger + Payroll”, “MYOB Business Lite”, “MYOB Business Pro”, “MYOB Business AccountRight Plus” or “MYOB Business AccountRight Premier” “Base subscription” excludes Premium Features such as Payroll and Premium Inventory. |

OFFER CONDITIONS
Who is eligible for the Offer? The Offer is strictly limited to Eligible Partners who subscribe to the Minimum Volume of Eligible Files. This Offer cannot be applied to Eligible Product subscriptions purchased during the Offer Period unless those subscriptions are also for Eligible Files.
When is the Offer available? The Offer is available during the Offer Period, unless otherwise varied by us.
How do you redeem the Offer? To redeem the Offer, you must during the Offer Period purchase the Minimum Volume of Eligible Files in a single transaction. This transaction must be completed by speaking with an MYOB sales agent and referencing the Offer; and if requested to do so, providing the sales agent with relevant information (such as customer entity name, ABN to set up the company data file). By redeeming the Offer, you agree that you are bound by these Terms.
What’s included in the Offer? If you accept the Offer (see section 3), you will receive the Discount on the relevant Eligible File subscriptions. You will receive the Discount for the Minimum Term.
Are there limits to the number of Eligible Products that my practice can purchase under the Offer? To redeem the Offer, you must purchase at least the Minimum Volume (5 Eligible Product subscriptions) in a single transaction. The Offer can be claimed for up to the Maximum Volume (100 Eligible Product subscriptions) per practice assessed across all Offer transactions for that practice.
Is there a minimum commitment? By redeeming the Offer, you are committing to pay for the subscriptions for all Eligible Products that you purchase under the Offer for the Minimum Term of each Eligible Product.
What happens if you cancel before the end of the Minimum Term? If you terminate any Eligible Product subscription before the end of the Minimum Term, then you will be invoiced and must pay the fees for the remainder of the Minimum Term.
What happens at the end of the Minimum Term? At the end of the Minimum Term, the cost of your Eligible Product subscription will automatically revert to your relevant Partner Program discount pricing. By providing us your credit or debit card details and agreeing to our Direct Debit Terms and Conditions, you acknowledge that the subscription automatically renews on a monthly basis and you authorise us to debit your credit or debit card the then-standard MYOB Partner pricing fees for your relevant MYOB Partner Program membership tier at the end of the Minimum Term.
What’s not included in the Offer? This Offer only applies to a base subscription for the Eligible Product. This Offer does not apply to MYOB Business Payroll Only nor to Premium Features (unless and to the extent that the then-current Eligible Product’s Terms of Use state otherwise). Use of Premium Features may attract additional fees or charges which will not be subject to the Discount in this Offer. This Offer cannot be used to purchase products for clients who have an existing MYOB paid subscription.
Can I upgrade within the Minimum Term? Yes, you can upgrade to any other Eligible Product within the Minimum Term, and the Offer will be transferred to the base subscription for that other Eligible Product. You cannot downgrade within the Minimum Term.
What other conditions apply to the Offer?
a) This Offer can be applied to multiple Eligible Product subscriptions purchased in the same transaction.
b) The Offer cannot be applied retroactively for prior purchases.
c) The Offer is not available in conjunction with any other offer and is not transferable.
d) You can use the best offer available to you at a single point in time, but not a combination of offers at any point in time.
e) Your use of the Eligible Product remains subject to the Eligible Product’s Terms of Use.
f) The recommended retail price is the price as advertised from time-to-time on www.myob.com (RRP). The RRP is subject to change at any time at MYOB’s discretion. If there is a price increase, we will give you notice in accordance with the Eligible Product’s Terms of Use.
g) If you accepted this Offer on an unsolicited sales call, this Offer is subject to a 10-day cooling-off period. If within the first 10-days of accepting this Offer you wish to terminate this agreement, you can do so without incurring a penalty. If you terminate within the 10-day cooling off period, any monies paid under this Offer will be refundable.
GENERAL CONDITIONS
MYOB Rights. Without limiting other remedies and in addition to rights under the Eligible Product’s Terms of Use or MYOB Partner Program terms we reserve the right to rescind any discounts provided to you under the Offer if:
you don’t comply with the Eligible Product’s Terms of Use, MYOB Partner Program terms or terms of use for other related MYOB products; or
in our opinion you are trying to obtain benefits from the Offer that you are not reasonably entitled to.
Your Rights. The Offer does not replace or limit your statutory rights, including your rights under applicable consumer laws.
Privacy and Data Use. We may collect and use information about you to administer the Offer. Your personal information will otherwise be used in accordance with our Privacy Collection Notice and Group Privacy Policy which contains more information on how we collect, use and disclose your personal information.
Changes. The Terms may be subject to change. We reserve the right to vary or withdraw the Offer at any time by providing you with notice. Notice will be affected in accordance with the notice requirements contained in the Eligible Product’s Terms of Use. We will honour the Offer if you have accepted the Offer prior to its withdrawal or variation.
Governing Law. These Terms are governed and construed in accordance with the laws in force in the State of Victoria, Australia.
Definitions. Unless the context otherwise requires, in these Terms:
Discount, Eligible Partner, Eligible Customer, Eligible Product, Minimum Term, Minimum Volume, Maximum Volume and Offer Period each have the meaning given to them in the key details section.
MYOB, we, us, our means MYOB Australia Pty Ltd (ABN 13 086 760 198).
Offer means this exclusive offer, which is offered to you by us under the Terms.
Terms means these terms and conditions.
You and your refers to the customer that is accepting this Offer under section 3.
