1. KEY DETAILS
Eligible Customer | means select Australian based customers of MYOB, who accepted the “12 Month 30% Discount on MYOB Business AccountRight” in 2023; and who have received this Offer from an MYOB sales or support agent; and that are redeeming this Offer in accordance with the requirements in clause 3 of these Terms. |
Eligible Product Subscription | means a base subscription to “MYOB Business AccountRight Basics”, MYOB Business AccountRight Standard”, MYOB Business AccountRight Plus” or “MYOB Business AccountRight Premier” that was previously discounted under the “MYOB Online Partner Additional AccountRight Live Plus Subscription” discount (otherwise known as the “Additional Data File” discount). “Base subscription” excludes Premium Features such as Payroll and Premium Inventory. For the avoidance of doubt, this Offer cannot be applied to existing MYOB customers. |
Discount | means a 30% discount on the then-current recommended retail price for the Eligible Product. |
Discount Period | means a maximum 12-month period. For the avoidance of doubt, this Discount Period is in addition to the 12 -month discount period offer under the “12 Month 30% Discount on MYOB Business AccountRight” offer. |
Offer Period | the period commencing on 9am on 1 May 2024 until 5pm on 31 December 2024, unless varied in accordance with section B.2 below. |
B. OFFER DETAILS
Who is eligible for the Offer? The Offer is strictly limited to Eligible Customers.
When is the Offer available? The Offer is available during the Offer Period, unless otherwise varied by us. All references to time in these Terms are a reference to the local time in the capital city of the applicable Territory, on the date stated.
How do you accept the Terms and redeem the Offer? Your continued use of the Eligible Product following the expiry of your Discount Period under the “12 Month 30% Discount on MYOB Business AccountRight” offer constitutes acceptance of these Terms, and you agree that, unless you contact us to decline the Offer, you are bound by these Terms.
What’s included in the Offer? After accepting this Offer in accordance with the Terms, the Discount will be applied monthly to the cost of the Eligible Product subscription for the Discount Period.
What’s not included in the Offer? This Offer only applies to a base subscription for the Eligible Product. This Offer does not apply to excess bank feeds or online invoice payments. By accepting this Offer, you agree to pay any additional fees or charges during the Discount Period.
When does the Discount Period commence? The Discount Period will apply from the beginning of the next billing period following the expiration of your discount period under the “12 Month 30% Discount on MYOB Business AccountRight” offer.
What happens at the end of the Discount Period? At the end of the Discount Period, the cost of your Eligible Product subscription will automatically revert the then-standard RRP or your relevant Partner Program discount pricing (whichever is applicable). By providing us your credit or debit card details and agreeing to our Direct Debit Terms and Conditions, you acknowledge that the subscription automatically renews on a monthly basis and you authorise us to debit your credit or debit card the RRP price at the end of the Discounted Period.
What happens if one or more of the Eligible Product Subscriptions are changed from “Partner Pays” to “Client Pays” throughout the Discount Period? This Offer continues to apply to Eligible Product subscriptions that have been transferred from a “Partner Pays” to a “Client Pays” payment profile.
What other conditions apply to the Offer?
This Offer can be applied to multiple Eligible Product subscriptions purchased in the same transaction.
The Offer cannot be applied retroactively.
The Offer is not available in conjunction with any other offer or discount.
You can use the best offer available to you at a single point in time, but not a combination of offers at any point in time.
Your use of the Eligible Product remains subject to the Eligible Product’s Terms of Use.
The recommended retail price is the price as advertised from time-to-time on www.myob.com (RRP). The RRP is subject to change at any time at MYOB’s discretion. If there is a price increase, we will give you notice in accordance with the Eligible Product’s Terms of Use.
If you accepted this Offer on an unsolicited sales call, this Offer is subject to a 10-day cooling-off period. If within the first 10-days of accepting this Offer you wish to terminate this agreement, you can do so without incurring a penalty. If you terminate within the 10-day cooling off period, any monies paid under this Offer will be refundable.
C. GENERAL
MYOB Rights. Without limiting other remedies and in addition to rights under the Eligible Product’s Terms of Use or MYOB Partner Program terms we reserve the right to rescind any discounts provided to you under the Offer if:
you don’t comply with the Eligible Product’s Terms of Use, MYOB Partner Program Terms (if applicable) or terms of use for other related MYOB products; or
in our opinion you are trying to obtain benefits from the Offer that you are not reasonably entitled to.
Your Rights. The Offer does not replace or limit your statutory rights, including your rights under applicable consumer laws.
Privacy and Data Use. We may collect and use information about you to administer the Offer. Your personal information will otherwise be used in accordance with the MYOB Group Privacy Policy which contains more information on how we collect, use and disclose your personal information.
Liability. To the extent permitted by law, MYOB will not be responsible for any loss incurred by you in redeeming or attempting to redeem the Offer or for any costs, damages, accident, delay, injury, loss, expense, or inconvenience that may arise in connection with the use of the Offer.
Changes. The Terms may be subject to change. We reserve the right to vary or withdraw the Offer at any time by providing you with notice. Notice will be affected in accordance with the notice requirements contained in the Eligible Product’s Terms of Use. We will honour the Offer if you have accepted the Offer prior to its withdrawal or variation.
Governing Law. These Terms are governed and construed in accordance with the laws in force in New Zealand (if we offer and you accept these Terms in New Zealand), and in accordance with the laws in force in Victoria, Australia (if we offer and you accept these Terms in Australia).
Definitions. Unless the context otherwise requires, in these Terms:
Discount, Discount Period, Eligible Customer, Eligible Product Subscription, and Offer Period each have the meaning given to them in the key details section.
Customer, you, your means the customer that is accepting this Offer.
MYOB, we, us, our means:
MYOB Australia Pty Ltd (ABN 13 086 760 198) if we offer and you accept these Terms in Australia; or
MYOB NZ Limited (NZBN 9429037875046, if we offer and you accept these Terms in New Zealand.
Offer means this exclusive offer, which is offered to you by us under the Terms and is subject to the Terms of Use of the Eligible Product.
Terms means these terms and conditions.
Territory means New Zealand, if we offer and you accept these Terms in New Zealand; and Australia, if we offer and you accept these Terms in Australia.
